Special assessments come up when the association doesn’t have budgeted funds to pay for something. Normally, if there’s expenditures, if there’s planned repairs, the association’s going to budget for that in advance. If we have community property, a pool, a clubhouse, when repairs are needed for the pool or the clubhouse, that’s going to be budgeted for. Those are going to be regular assessments that you’re going to pay. When something pops up outside the ordinary, something on an emergency basis or just something that simply wasn’t planned for, that’s going to be assessed against all the homeowners as a special assessment over and above the general assessments. If we’re talking about fines, we’re talking about doing something wrong. Generally, you’re not going to get a fine for not paying your assessment. You’re going to owe late fees, administrative fees, but if we’re talking about a fine, that means you’ve breached some sort of deed restriction or restrictive covenant, and generally speaking, you’re going to look to that document to determine when they can actually find you. That should be outlined in the governing documents for the association. If it’s not, Florida law is going to allow you an opportunity to get heard in front of a committee, but refer to your documents.
