Breach of contract is basically somebody breaking their agreement. However, in Florida there are specific elements required for a breach of contract. The first, there must be a contract. A contract is generally an agreement between parties to do something. Both sides need to make a promise. There also needs to be a material breach of that contract, which means that one of the terms of the contract wasn’t followed by one of the parties, and it was an important term. Finally, there needs to be damages flowing from that breach. In other words, one of the two parties suffered as a result of the other party not performing.
